NutriVue: Food Scanner — Terms of Service

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under the age of majority, you may use the App only with the involvement of a parent or legal guardian.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on devices you own or control.

Some features require an account. You agree to provide accurate information, keep your credentials secure, and are responsible for all activity under your account. Notify us promptly of any unauthorized use. You may request deletion of your account at any time via our NutriVue account deletion page.

You agree not to:

• Use the App for any unlawful, harmful, or fraudulent purpose.
• Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
• Interfere with or disrupt the App, its servers, or networks, or bypass security measures.
• Upload malicious code or infringe the rights of others.
• Resell, sublicense, or commercially exploit the App without our written permission.

The App lets you create and store content such as logs, entries, and preferences ("Your Content"). You retain ownership of Your Content. You grant us a limited license to host, process, and display Your Content solely to operate and provide the App to you. You are responsible for Your Content and confirm you have the rights to submit it.

NutriVue provides nutrition information and estimates for general informational purposes only. Scan results and nutritional values may be incomplete or inaccurate and are not a substitute for professional dietary or medical advice. Always consult a qualified healthcare provider or registered dietitian regarding your nutrition, allergies, or any health condition.

The App does not provide medical advice and is not intended to diagnose, treat, cure, or prevent any disease or health condition. You use the App and act on its information at your own discretion and risk.

The App may integrate with or link to third-party services (such as app stores, analytics providers, or health platforms). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

If the App offers paid features or subscriptions, they are billed through the applicable app store (Apple App Store or Google Play). Prices, renewals, and cancellations are managed through your app store account in accordance with its terms. Except where required by law, payments are non-refundable.

The App, including its software, design, text, graphics, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that results (including nutrition or fitness data) will be accurate or reliable.

To the maximum extent permitted by law, Alpha Omega Vitality and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim will not exceed the greater of the amount you paid us for the App in the 12 months before the claim or USD $50.

You agree to indemnify and hold harmless Alpha Omega Vitality from any claims, damages, liabilities, and expenses arising out of your use of the App, Your Content, or your violation of these Terms.

We may suspend or terminate your access to the App at any time if you violate these Terms or if we discontinue the App. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination will continue to apply.

We may update these Terms from time to time. We will revise the "Effective date" above and, where appropriate, provide additional notice. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where your local consumer-protection laws provide otherwise.
